Voluntary Petition

A voluntary case under Chapter 7 is commenced by the debtor filing a petition. See BRA section 301 and Bankruptcy Rule 1002. Most bankruptcies, including Chapter 7 bankruptcies, are voluntary. Under BRA section 109(b) any person who is not a railroad, insurance company or lending institution may file a Chapter 7 bankrutpcy.
